Terms and conditions of sale

Article 1 – Seller

These terms govern sales made on the NESTIVA website, operated by Eric Remmache, sole trader (micro-entreprise), 80 rue Saint-Sébastien, 78300 Poissy, France. SIRET: 519 576 946 00015. Email: contact@nestiva.fr. Phone: +33 7 69 78 85 93.

Article 2 – Scope

These terms apply to any order placed on the website by a consumer. Placing an order implies full acceptance of them.

Article 3 – Products

The essential characteristics of the products are presented on each product page. Slight variations in shade and grain, inherent to wood as a natural material, may occur.

Article 4 – Prices

Prices are shown in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. Any delivery costs are shown before the order is confirmed.

Article 5 – Order and payment

The order is confirmed once payment is confirmed, made online via a secure platform. A confirmation email summarising the order is sent to the customer.

Article 6 – Delivery

Products are delivered to the address given by the customer, within the times stated on the website and at checkout. In the event of a significant delay, the customer may exercise the rights provided for in articles L. 216-1 et seq. of the French Consumer Code.

Article 7 – Right of withdrawal

In accordance with article L. 221-18 of the French Consumer Code, the customer has 14 days from receipt of the product to withdraw, without giving a reason. NESTIVA voluntarily extends this period to 30 days. The customer notifies their decision by email to contact@nestiva.fr. The refund is made within a maximum of 14 days.

Article 8 – Legal guarantees

All products benefit from the legal guarantee of conformity (articles L. 217-3 et seq. of the French Consumer Code), valid for two years from delivery, and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of non-conformity, the customer may obtain repair or replacement of the product, or failing that a price reduction or refund.

Article 9 – Personal data

Collected data is processed in accordance with our privacy policy.

Article 10 – Mediation and disputes

In the event of a complaint, the customer first contacts NESTIVA by email. If no amicable solution is found, they may use a consumer mediator free of charge, whose details appear in our legal notice. These terms are governed by French law.
